Microsoft loses appeal in Vista ready case

Microsoft
has lost its bid to have the embarrassing 'Vista ready' case demoted from being an expensive class action.

The case, over whether Microsoft lied to people by claiming computers were ready for Vista when their hardware could only manage a cut down version of the software, had been accepted as a class action by the court.

Microsoft had appealed against the decision, worried that it could lead to another expensive class action against it. It mentioned 'continuing the lawsuit might mean new disclosures of insider e-mails, which could "jeopardize Microsoft's goodwill" and "disrupt Microsoft's relationships with its business partners."

The emails, which show that Microsoft knew its Vista campaign was bogus, have been a source of embarrassment to the company. What Microsoft fears is that more emails will come to light. But the U.S. Ninth Circuit Court was not buying that argument and has sent the case back to court as a class action.
