Claims patent infringement

ZapMedia has filed an action against Apple, Inc. in U.S. District Court in Texas, claiming that Apple’s iPod players and iTunes online music store violate two existing ZapMedia patents for Internet digital media distribution.  The applications for the two patents were filed in 1999; one was granted to ZapMedia in 2006 and the second was just granted this week.

ZapMedia claims that both patents cover a method of sending music and digital content to multiple media players from servers, and ZapMedia admitted that Apple is not likely the only company violating these patents in the event the Court rules in ZapMedia’s favor. The action asks for royalties from Apple for violation of ZapMedia’s patents.

Apple sales of iPods and iTunes music in 2007 amounted to nearly $11 billion.
