Activision claims rights to Brutal Legend

Double Fine deal with EA could be invalid

Looks like Activision might be looking to get paid, as sources are telling us that both Double Fine and Electronic Arts have received letters from Activision claiming that it still owns the publishing rights to Brutal Legend.

Brutal Legend was a victim of the Activision-Vivendi merger and Double Fine insists that they own the rights to their work, and Electronic Arts is the new publisher that will be releasing the title when it is completed.

While Activision is claiming that the deal that Double Fine has with EA is invalid, sources are suggesting that the move by Activision is more of a “shake down,” similar to what the company did with both Ghostbusters and Chronicles of Riddick Assault on Dark Athena in an effort collect some compensation for releasing the rights. Atari, who picked up both Ghostbusters and Dark Athena, did write a check to Activision.

EA is firm in its belief that they have the rights to publish the title, and according to our sources they believe it unlikely that the company will sue. We think it is possible that this could get ugly before it is all said and done, but Activision basically abandoned the title and developer Double Fine; but it is unclear as to the ins and outs of the arrangement that they had with Activision. Stay tuned, this could ultimately delay the release of Brutal Legend yet again.
