Nexus One launched 6 months after 3GS and is updated regularly... it has 2.3.6 OTA. Google doesn't give old hardware, software it simply can't run well, which is why the G1 never saw 2.2, I did happen to run a custom rom for my G1 so I could run 2.2 and while it did run well... the memory was very limited. Magic did happen to get that version of the os. So I am not sure what your article is about, Android's OS updates are largely left to the companies that make the phones. Which is why only Nexus phones usually get regular updates.

It's no different on say Windows 7 (PC). You can download the hotfixes without having the service pack, but the people want that service pack to move up the OS version digits a few points and feel part of the club and not left out.

Of course you forgot to mention that that shiny iOS 5 running on your 3GS won't actually have the same features as iOS 5 running on an iPhone 4, or iPhone 4S. Or that the differences between Froyo and Gingerbread are largely cosmetic and that many services internal to iOS are separate downloads for Android. And thus, upgradable separately. Putting the FUD in Fudzilla I gather.
