They CLEARLY tell you that the factory setting is 375W "factory-supported" Performance BIOS (BIOS1). Its on their web page! You can even ask a lawyer about it as I "know" AM-DUNG did! :D THE GIMMICK SWITCH IS NOT COVERED!!]]></description>

			<description><![CDATA[Right... what you don't get is that either positions of the switch 1 or 2 are factory settings. Period. And you can ever ask a lawyer about it and he/she will say the same thing. Also you don't seem to get that XFX could come out and say this only because these settings are covered by warranty. They're not BFG! The only case in which the settings that a user applies are not factory settings are those done through 3rd party OC utilities or BIOS flashing and neglecting of the minimum requirements. BTW, I know you're really stubborn and will not let loose the AMD-bashing in any way. I stated a correction and that's it, no point commenting further.]]></description>

Position 2 (shipping position) — 375W factory-supported Performance BIOS (BIOS1). The very last section is in all caps and underlined! 			<description><![CDATA[@Warrior24_7, a system would only burn up if the PSU used doesn't meet the minimum requirements written in the user's manual. Put a lower specked PSU or a cheapo non-certified one that doesn't have the minimum of failure-protections and even if it is rated 750W but in reviews it gets laughed at for not being able to supply even 500W and that, buddy, is not AMD's fault.]]></description>

			<description><![CDATA[@trancer23 Here is why this is a big deal. In the US, a warranty covers a product if its defective, the manufacturer's fault. AM-DOO DOO is saying that if you flip that switch and burn up your card or system, then its "your" fault as they warned you not to do it! So its not covered. Now I don't know UK or EU law (or care, as I don't live there) but I don't know any type of warranty or Statutory law that would allow the consumer to damage an item then return it for a refund!]]></description>

			<description><![CDATA[Remember again under UK and EU law there is no need for a company to issue any warranty. Goods are covered as standard by a Statutory law. A warranty typically adds to these default rights. They cannot take away from these rights and so I would view the provision of a BIOS switch as part of the integral system and therefore covered under the statutory obligations of the producer of those goods. Alot of the statutory law is also quite vaugue in that goods need to be of 'reasonable' quality and 'fit for purpose' not to get out of claims but the very opposite to ensure that the consumer is protected.]]></description>
